Two Olney men face trial on child sex charges
Two Olney residents and a Newcastle man will be tried on charges of child sex abuse and assault charges in the 90th Judicial District Court.
Seth Cody Wakefield, 33, of Olney, Andrew James Garibay, 31, of Olney and Michael Lee Moore, 35, of Newcastle have had trial dates set for late 2023 and 20023, according to the District Attorney’s Office.
Wakefield was indicted last year by a Young County grand jury on charges of sexual assault of a child younger than 17 years old. His trial is set for Feb. 2, 2024.
Wakefield was arrested after the Olney Police Department received a report of a possible sexual abuse of a child after the victim was taken to Cook Children’s Medical Center on June 10, 2022, according to a probably cause affadavit. The alleged victim reported being assaulted by Wakefield between 20-25 times, the affadavit said.
Wakefield is in Young County Jail in lieu of $181,350 bail.
Garabay was indicted in July 2022 by a Young County grand jury for aggravated sexual assault of a child, indecency with a child by sexual cntact and indecency with a child by exposure. His jury trial is set for Friday, Dec. 8.
He was arrested Feb. 17 on allegations that he abused a child from May 2018 to May 2021.
The victim allegedly told a forensic examiner that Garibay sexually assaulted them beginning at age seven until age nine.
The abuse came to the attention of authorities when a friend of the vic- tim reported it, the affadavit states. Mr. Garibay is in Young County Jail in lieu of $75,000 bail.
Mr. Moore was indicted by a Young County grand jury in September of 2022 on a charge of indecency with a child by sexual contact. Mr. Moore’s jury trial is set for Feb. 2, 2024.
The indictment alleges that Mr. Moore engaged in sexual contact with a child under 17 years of age on or about May 14, 2020. The victim’s mother reported the incident to the Young County Sheriff ’s Office a few days later, the probable cause affadavit said.
The victim told investigators that Mr. Moore touched her inappropriately while they were lying on a couch, the affadavit stated. Mr. Moore was arrested on Nov. 5, 2022 and booked into Young County Jail and released the same day on $15,000 bond.
